1. Scope of Application

These Terms and Conditions apply to all contracts between Florian Silly (hereinafter referred to as “Coach”) and his clients (hereinafter referred to as “Participants” or “Clients”) for coaching services concluded verbally, in writing, or electronically (e.g. via website, email, or booking platforms).
Any deviations or additional agreements are only valid if confirmed in writing.

2. Description of Services

The coaching program is designed to support the personal development of the client and to promote clarity, awareness, and inner alignment.
It is explicitly not a psychotherapeutic, medical, psychological, or healing practice. No diagnoses are made, and no physical or psychological disorders are treated, alleviated, or therapized.

The coach works exclusively in a process-oriented and resource-based manner, supporting clients in mindfulness, self-reflection, focus, and conscious goal orientation. Full responsibility for decisions, actions, and outcomes rests entirely with the client. No guarantee of success is given, as the coaching process depends significantly on the client’s active participation and personal responsibility.

3. Conclusion of Contract

A contract is concluded once the client books a coaching program in writing, electronically, or verbally, and the Coach confirms the booking.
Booking can take place via email, online calendar, or by signing an offer.

4. Services and Duration

The coaching program includes the services described in the offer or on the website (e.g. number and duration of sessions, formats, supporting materials).
Changes in process or content adjustments that serve the client’s progress remain at the discretion of the Coach.
All sessions take place either in person or online (e.g. via Zoom).

5. Fees and Payment Terms

The agreed fee is to be paid in advance or according to the individual agreement stated in the offer or invoice.
All prices are in euros and – unless otherwise stated – exempt from VAT pursuant to § 6 Abs. 1 Z 27 UStG (small business regulation).
Installment payments may be arranged by mutual agreement.

6. Cancellation, Rescheduling and Withdrawal

Cancellations or rescheduling of appointments are possible free of charge up to 48 hours before the appointment.
In case of shorter notice, the full amount will be charged unless a valid reason (e.g. illness) is provided.
If the coaching is terminated by the client, there is no entitlement to a refund of amounts already paid, unless the termination occurs for important reasons for which the Coach is responsible.
The statutory right of withdrawal for consumers in distance contracts remains unaffected (see Section 7).

7. Right of Withdrawal for Distance Contracts

If the contract is concluded via distance communication, consumers are entitled under §§ 11 ff FAGG to withdraw from the contract within 14 days without giving any reason.
The withdrawal period begins upon conclusion of the contract.
To exercise the right of withdrawal, a clear declaration by email to info@infiniteflow.at is sufficient.
Important Notice: If the coaching program begins at the express request of the client before the expiry of the 14-day period, the right of withdrawal expires upon commencement of the service (§ 18 Abs. 1 Z 11 FAGG).

8. Disclaimer of Liability

The Coach assumes no liability for decisions, actions, or results made by clients during or after the coaching process.
Coaching is not a substitute for psychological, medical, or therapeutic treatment.
Clients are fully responsible for their actions during and after the coaching.

9. Confidentiality and Data Protection

The Coach commits to absolute confidentiality regarding all personal and business information of the clients.
The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR).

10. Copyright

All materials, texts, meditations, or videos provided by the Coach are protected by copyright.
Any reproduction or distribution – even in part – is only permitted with the Coach’s written consent.

11. ZFU and Training Character

The coaching program is not a distance learning course within the meaning of the German Fernunterrichtsschutzgesetz (FernUSG) and is not subject to ZFU approval.
It serves personal development and consciousness work and does not include any formal training, examination, or certification.

12. Final Provisions

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
The place of jurisdiction is Innsbruck, Austria.
Austrian law applies exclusively.
